  1. DESCRIPTION: The SAP Cloud Portal Developer Challenge is a skill-based contest that is intended to encourage developers to demonstrate their developer excellence and leverage the development features of SAP Cloud Platform Portal (the “Contest”). Entrants should create an idea for a cool business use case and start with the implementation. We have created a special wiki page dedicated to provide entrants with detailed information about the contest task and the development capabilities of SAP Cloud Platform Portal. The contest is announced by a blog on SAP Community written by SAP Portal Product manager Vera Gutbrod.

  2. SPONSOR: SAP America, Inc. (“Sponsor”), 3999 West Chester Pike, Newtown Square, PA 19073.

  3. TIMING: The Contest begins around 04:00 p.m. Central European Time (CET) on October 17, 2018 and ends 12:00 p.m. CET on March 29, 2019. Entries, which include all components described in these Official Rules, must be received during the Contest Entry Period (or such other period of time within the Entry Period as designated in these Official Rules) by Sponsor in accordance with the procedure and approved channels stated herein, or will not be eligible.

  4. ELIGIBILITY: The Contest is open to individuals (referred to as “Entrants”, or on occasion “you” or “your”) who:

    1. are the legal age of majority to form valid contracts in their respective country, province, or state of legal residence at the time the entry is submitted; and

    2. are legal residents of ARGENTINA, AUSTRALIA, AUSTRIA, BELGIUM, CANADA (EXCLUDING QUEBEC), CHILE, CHINA, COLOMBIA, CZECH REPUBLIC, DENMARK, FINLAND, FRANCE, GERMANY, HONG KONG, HUNGARY, INDIA, INDONESIA, ISRAEL, JAPAN, MALAYSIA, MEXICO, NETHERLANDS, NEW ZEALAND, NORWAY, PERU, PHILIPPINES, POLAND, PORTUGAL, RUSSIAN FEDERATION, SINGAPORE, SOUTH AFRICA, SOUTH KOREA, SAUDI ARABIA, SPAIN, SWEDEN, SWITZERLAND, TAIWAN, THAILAND, TURKEY, UNITED ARAB EMIRATES, UNITED KINGDOM, THE UNITED STATES, VENEZUELA (THE “ELIGIBLE COUNTRIES”). 

      Employees, officers and representatives of SAP, and related companies, as well as their employees and immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.
      EMPLOYEES OR INDIVIDUALS IN ANY WAY AFFILIATED WITH OR RELATED TO ANY GOVERNMENT ENTITY, GOVERNMENT OFFICIAL, OR ANY OTHER PERSON OR ENTITY IN THE PUBLIC SECTOR MAY ONLY PARTICPATE UNDER THE LIMITED CIRCUMSTANCES SET FORTH IN THESE OFFICIAL RULES, NAMELY, THEY ARE NOT ELIGIBLE FOR THE PRIZE LISTED IN SECTION 8 OF THESE OFFICIAL RULES.

      THIS CONTEST IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. THIS CONTEST IS VOID TO RESIDENTS OF ALL OTHER COUNTRIES AND WHEREVER RESTRICTED BY, WITHOUT LIMITATION, FILING OR REGISTRATION REQUIREMENTS, OR OTHERWISE PROHIBITED OR RESTRICTED BY LAW.

      By participating in the Contest, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor in all matters relating to this Contest, which are final and binding. Entrants have the responsibility to review and understand their employer’s policies, laws, rules and/or regulations, tax implications, and any other limitations (collectively “policies”) regarding eligibility to participate in promotions and/or receive prizes in connection therewith.  Furthermore, if you enter without obtaining the appropriate approvals, or if an individual is participating in violation of any such policies, Sponsor may, in its sole discretion, disqualify you and/or your Entry, and forfeit the prize, if applicable. Entrant warrants that the appropriate corporate officers, executives, managers or other persons of the entity on whose behalf the Entry was submitted (in the case of the Partner track) have approved the Entry, and understand and agree that these Official Rules will be binding on both the individual submitting the Entry and the entity on whose behalf the Entry was submitted.

  5. HOW TO ENTER:  Entrants contact the SAP Portal product management team by sending an email to sapportal@sap.com and inform the Portal product management team about their intention to join the challenge. With sending this email entrants officially join the challenge. During the Contest Entry Period, Entrants participate in this Developer Contest by providing the information requested by writing a blog on SAP Community. Entrants create a blog and write in the title “SAP Cloud Platform Portal Developer Challenge: <your own title> “ (the “Entry” and “Entries” when talking about more than one Entry). Entrants tag their blog with “SAP Cloud Platform Portal” and add as additional tags “SAP Cloud Platform” and maybe additional other tags, which suit their content. Entrants describe their development project and your business case in the blog and insert some screenshots or a link to a recording.
    Entrants are required to provide general information such as the following: their email address to join officially the challenge, to receive the prizes (see section 8) or in case the jury had additional questions to the blog describing the project. They will need to send their email addresses to the SAP Portal official email account sapportal@sap.com.  It is the Entrant’s sole responsibility to ensure Sponsor has their current contact information.  In whole or in part invalid, non-compliant or incomplete Entries will not be considered.

  6. Determining Winners (for the Prizes listed in Section 8, below):
    All Entries will be reviewed by a jury, which consists of experts from the SAP Portal product management team plus additional experts. The jury will determine the winners (that is  1st, 2nd, and 3rd place in the Contest). The criteria for determining the winner will be: technical level; creativity and innovation; business relevance; design, user experience. The jury reserves the right to exclude from the challenge any blog/entry without meaningful content. Once we have reviewed your blog and taken a first sight, we will inform you in the blog comments, that your Entry was accepted and also ask to send us your email address to sapportal@sap.com so that you can be informed about your prize.
    The winners will be defined only after the challenge is completely finished on 12:00 p.m. CET March 29, 2019 and jury will have received all Entries described in SAP Community blogs.
    The judging will take place in April 2019. The winners will be announced beginning of May 2019 on the SAP Community website in the contest announcement blog and also via direct email sent to the winners (place 1, 2 and 3).

    In order to be eligible for this Contest, all Entries, in whole and in part (and the Entrant) must comply with all other terms stated in these Official Rules. Entrants agree that neither Sponsor nor SAP are responsible for, and they shall be indemnified, defended, released and held harmless for/from any claims, actions or disputes between an Entrant and any other Entrant and/or third party relating to the Contest or any Entry, in whole or in part.  Once you submit your Entry, it is final and may not be modified or edited. No Entry will be returned. The jury’s decisions are final and binding on all matters relating to this Contest.

  7.  INTELLECTUAL PROPERTY RIGHTS: With the exception of the rights granted in these Official Rules, as between Sponsor and the Entrant, the Entrant has and retains all intellectual and proprietary rights in and to the Entry that Entrant had at time of submission of the Entry. As a condition of entry, Entrant grants Sponsor, SAP, its affiliates, and others involved in the preparation of materials for, administration and execution of this Contest (“Contest Administrators”) a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, publicly perform, and publicly display the Entry in whole or in part that Entrant submits to this Contest to  allow the Entry to be  evaluated for purposes of this Contest, to administer the technical and other requirements of the Contest, including distribution of the Entry to the Contest Administrators, for prize award verification, and for promotional purposes.

    Entries may not be acknowledged and will not be received or held “in confidence” or “in trust” and by submitting an entry it does not create a confidential relationship or obligation of secrecy between Entrant and Sponsor, its affiliates, or any person or entity involved in the administration of the Contest. Entrants will not now or in the future be entitled to any approval, rights of compensation, or any other payment; unless adjudged and verified a winner pursuant to these Official Rules, and in such event, only to the extent of the prize award.

  8. PRIZES: All Entrants whose Entries were accepted by the jury will receive a SAP Cloud Portal Developer Award of Excellence, which will be sent to the Entrants via email.
    The top three (3) Entries will receive:
    First Place Prize (one prize): The winner will be offered one conference pass for SAP TechEd 2019 in US, EMEA or India (depending on the winner's preference). Sponsor will only be awarding tickets as prizes.  All transportation, lodging, meals, gratuities, and all costs and expenses relating to or arising directly or indirectly out of the Prize are the responsibility of the winner. Approximate Retail Value of each prize ticket: Approximately $2,000 USD.
    If the winner contributes to the Contest as a team, this team must agree on one person to get the pass. 
    There will also be an SAP Cloud Portal Developer Award of Excellence, winner award for first place sent via email. 

    Second Place Prize: SAP Cloud Portal Developer Award of Excellence, winner award for second place sent via email. 

    Third Place Prize: SAP Cloud Portal Developer Award of Excellence, winner award for third place sent via email. 

    No other prize elements except those specifically described here are awarded. Prizes are not transferable and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, which reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value, at its sole discretion. All federal, state and local taxes, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the potential winner’s responsibility (e.g., any customs duty). All prize details are at the Sponsor’s sole discretion.

  9. PRIZE NOTIFICATION:  Potential winners will be notified beginning of May 2019 , online in the contest announcement blog and by email based upon the information submitted by the Entrant. If any prize winner cannot be contacted using the contact information provided within a timeframe of two weeks or if a prize winner cannot accept or receive the prize that they were awarded for any reason, or any non-compliance with these Official Rules, that prize will be forfeited and awarded to the Entrant with the next highest score.
    Sponsor reserves the right, without notice or prior approval, to modify or supersede these Official Rules in its sole reasonable discretion and in such event will post revised Official Rules on the web site, which will continue to govern all aspects of the Contest.

  10. Contest Administration/Publicity: Except where prohibited, participation in the Contest constitutes winner's consent to Sponsor’s use of winner's name, likeness, and biographical information for purposes of administering the Contest, including publication of information about winning entrants in accordance with applicable laws and regulations. Use of personal information for advertising and promotional purposes will be subject to the consent of the participant.
  11. GENERAL ENTRY CONDITIONS: Sponsor is not responsible for problems uploading or downloading any Contest related information from the website or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic entry submission to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the website, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in this Contest. If applicable, mass entries or entries generated by a script, robot, macro, or use of automated devices will be disqualified. Sponsor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor reserves the right at their sole discretion to disqualify any individual they find to be tampering with the entry submission process or the operation of this Contest or web site or to be acting in violation of the Contest Official Rules.
    Without limiting any other right or term herein, an Entrant may be disqualified from the Contest if, in Sponsor’s absolute discretion, it reasonably believes Entrant has, appears to, or has attempted to undermine the legitimate operation of the Contest by cheating, deception, fraud, using multiple identities, engaging in illegal activities, or other unfair practices, or has or attempts to annoy, abuse, threaten, harass or intimidate any other Entrant, or any other person. Sponsor is not responsible if the Contest cannot take place or if any prize cannot be awarded due to travel cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather, or acts of terrorism. Sponsor reserves the right to cancel or suspend the Contest at its discretion. Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes.

  12. PRIVACY:  Entrants agree that personal data entered during the participation in the Contest may be processed, stored, and otherwise used for the purposes and within the context of the Contest and as permitted by and in accordance with the Sponsor’s Privacy Policy found at http://global.sap.com/corporate-en/legal/privacy.epx. This data may be collected and maintained within the United States. By entering, Entrants expressly agree to the transmission, processing, and storage of this personal data in the United States.

  13. LIMITATION OF LIABILITY. 

    THESE OFFICIAL RULES SHALL GOVERN THE CONTEST, INCLUDING BUT NOT LIMITED TO ENTRY, PARTICIPATION, ELIGIBILITY TO RECEIVE A PRIZE, AND ENTRANTS AND OUR RESPECTIVE OBLIGATIONS WITH RESPECT THERETO. USE OF THE SITE, INFORMATION PRACTICES, AND ALL OTHER GENERAL TERMS ARE GOVERNED BY SPONSOR’S TERMS OF USE AND/OR PRIVACY POLICY AT SAP.COM. IN THE EVENT OF A DISCREPANCY BETWEEN ANY INFORMATION, COMMUNICATION, AND/OR TRANSLATION, THESE OFFICIAL RULES SHALL GOVERN ISSUES RELATING TO THE CONTEST. 

     

    IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THIS CONTEST, PARTICIPATION IN THE CONTEST, ANY CONTEST ACTIVITIES OR ELEMENTS THEREOF, INCLUDING BUT NOT LIMITED TO THE SUBMISSION OF AN ENTRY, ENTRANT’S ACCESS TO AND USE OF THE PROMOTIONAL WEBSITES OR THE UPLOADING OF MATERIALS TO THE WEBSITE, AND/OR THE DELIVERY, ACCEPTANCE AND/OR USE/MISUSE OF A PRIZE.

  14. RELEASE AND INDEMNIFICATION: To the maximum extent permitted by law, Entrants and winners agree to release, indemnify, defend and hold harmless (“release”) Sponsor, SAP, and their parents, affiliates, subsidiaries and divisions, and their respective directors, officers, employees and agents (“Released Parties”) from and against any and all threatened or actual actions, liabilities, claims, demands, losses, settlements, fines, damages, costs and expenses (including reasonable attorney fees) whether or not litigation is commenced (“dispute”) arising at any time from participation in the Contest, the Entries (in whole or in part), any Contest and/or prize-related activity or inability to participate in or parts thereof, the delivery, acceptance, use, mis-use of a prize or any failure with respect thereto, personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, any act, default, omission, non-compliance, and/or a violation or breach of any agreement, representation, warranty or covenant made herein, or any other agreements by/with Entrant, Sponsor, SAP, and/or any other party or entity. Further, to the maximum extent permitted by law, and without limiting the foregoing, Entrants and winners agree to release the Released Parties from and against any and all threatened or actual disputes arising at any time directly or indirectly  from  any dispute brought by any persons or entities (who may be other than a party to the Official Rules) arising from or related to an entry, participation and/or involvement in any other respect with the Contest, and/or the delivery, acceptance, use, mis-use of a prize or any failure with respect thereto.  Entrants and winners covenant not to sue any Released Party or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit, or rescind this release. A waiver by Sponsor of any term in these Official Rules does not constitute a waiver of any other provision.  Except where prohibited by law, acceptance of any prize constitutes permission for Sponsor and its designees to use the winner's name, likeness, statements, and other personally identifiable information provided in connection with the Contest for advertising and marketing purposes in any media throughout the world without any additional prize, incentive, consideration, consent or review.

  15. APPLICABLE LAW: These Official Rules shall be governed by, subject to, and construed in accordance with the laws of the State of New York, United States of America, without regard to conflict of law rules. If any item or provision contained in these Official Rules or any part thereof is declared or becomes unenforceable, invalid or illegal for any reason, all other terms and provisions of these Official Rules shall remain in full force and effect as if these Official Rules had been executed without the offending provision appearing therein.
